Refurbished vs New: How Warranties and Return Policies Actually Differ
Who stands behind the device, for how long, and what happens when it fails at month 14 - including the ACL rights that apply no matter what the warranty says.
Warranty guide · RefurbVerify Editorial · Updated 14 July 2026 · Independent, no vendor payments
Quick answer: New devices carry a manufacturer warranty (typically 24 months in Australia); certified refurbished devices carry the seller's own warranty — 12 months standard, 24 at the best (
Mobile Guru). Refurb warranties cover functional failure but usually exclude battery degradation below a stated floor, accidental damage and cosmetic wear. The equaliser: Australian Consumer Law guarantees apply to refurbished purchases from businesses exactly as they do to new — and they survive the seller's warranty expiring. Expect, as a baseline from any seller worth buying from: 12 months coverage, 30-day returns and a stated battery guarantee.
The three differences that matter
1. Who stands behind it
A new iPhone's warranty is Apple's. A refurbished iPhone's warranty belongs to whoever refurbished or sold it — the original manufacturer's warranty almost never transfers. That makes the seller's identity the single most important term in the contract: a warranty from an established Australian seller with a service operation is worth far more than the same words from an anonymous marketplace storefront whose "warranty" routes to an offshore refurbisher. Always confirm who actually services claims.
2. How long it runs
| Purchase type | Typical coverage (Australia, 2026) |
| New phone (Apple/Samsung) | 24-month manufacturer warranty + ACL |
| Apple Certified Refurbished | 12 months (Apple) — eligible for AppleCare+ |
| Top AU refurb specialists | 12 months standard; Mobile Guru 24 months; extensions offered at checkout |
| Marketplace refurb (Back Market, Amazon Renewed, Big W) | 12-month minimum seller warranty, platform guarantee on top |
| Private sale (Gumtree, Facebook, Vinted) | None — and no ACL guarantees between individuals |
3. What is actually covered
Refurb warranties cover functional defects — dead pixels, failed charging, faulty cameras, batteries falling below the guaranteed floor. They do not cover accidental damage, liquid ingress, cosmetic wear consistent with the purchased grade, or normal battery degradation above the floor. Read the battery clause closely: "80% health guaranteed" means a battery at 81% after eleven months is not a warranty claim.
The equaliser: Australian Consumer Law
Whatever the warranty says, ACL consumer guarantees apply to refurbished goods bought from a business exactly as they apply to new goods. The device must be of acceptable quality judged against its price and described condition, fit for purpose, and match its description. Two practical consequences: a refurbished phone that dies at month 14 may still entitle you to a remedy even on a 12-month warranty, and a seller saying "warranty expired, nothing we can do" is not the end of the conversation. The ACCC has also warned sellers over loose refurbished labelling — description accuracy is a legal obligation, not a courtesy.
What coverage to expect, by seller type
- Refurb specialists (Reebelo, OzMobiles, Mobile Guru, Green Gadgets): 12–24 month warranties they service themselves, 30-day returns, stated battery floors. The benchmark.
- Refurb marketplaces (Back Market): 12-month minimum enforced across third-party sellers plus a platform money-back guarantee — but the individual seller services the claim, so check their rating too.
- Big-retail refurb ranges (Amazon AU Renewed, JB Hi-Fi, Big W): 12-month seller warranties; the retailer hosts, a third party stands behind the device. Confirm the claim path before buying.
- Private sales: no warranty, no ACL. Price accordingly and check the IMEI.
Red flags in refurbished warranty terms
- Warranties under 6 months — below every reputable Australian seller's floor.
- "Warranty void if opened" stickers — repair-restriction terms sit uneasily with Australian law; treat as a seller-quality signal.
- Claims serviced by an unnamed overseas refurbisher rather than the seller you paid.
- No written battery guarantee at all.
- Store-credit-only remedies for functional failures — ACL entitles you to more for major failures.
Frequently asked questions
How do certified refurbished electronics warranties differ from those of new products?
Three main differences. Issuer: new devices carry a manufacturer warranty (Apple, Samsung), while refurbished devices carry the refurbisher's or seller's own warranty - the manufacturer's original warranty rarely transfers. Length: new phones in Australia typically get 24 months of manufacturer coverage; refurbished standard is 12 months, with Mobile Guru's 24 months the current benchmark. Scope: refurb warranties cover functional failure but commonly exclude batteries below a stated threshold, accidental damage, and cosmetic wear. In Australia, Consumer Law guarantees apply equally to both new and refurbished purchases from businesses.
What warranty coverage should I expect when buying refurbished in Australia?
From a reputable certified seller: a minimum 12-month seller-serviced warranty covering functional defects, a 30-day change-of-mind return window, and a stated battery-health guarantee (80%+ is standard). On top of any warranty, Australian Consumer Law gives you guarantee rights - a refurbished device must be of acceptable quality for its price and described condition, and you can seek repair, replacement or refund for major failures even after the seller's warranty expires.
Does Australian Consumer Law cover refurbished devices?
Yes. ACL consumer guarantees apply to refurbished goods sold by businesses exactly as they do to new goods - the device must be of acceptable quality, fit for purpose, and match its description, judged against its price and stated condition. A seller's own warranty operates in addition to these rights, never instead of them. Private sales between individuals are the exception: ACL guarantees don't apply, which is why IMEI and condition checks matter more there.
Do refurbished return policies differ from new products?
Usually the refurbished policy is more generous than people expect: 30-day change-of-mind returns are standard among top Australian refurb sellers (Reebelo, OzMobiles, Back Market and Mobile Guru all offer them), whereas many retailers offer limited or no change-of-mind returns on new phones. Check who pays return shipping and whether the refund is cash or store credit.
